cancellations, refunds and fees:

RENTALS:

• Security deposits for all Renter cancellations are non-refundable. Renter will be charged the full amount of the security deposit. No refunds or credit voucher will be issued.

• Same day Renter cancellations are non-refundable. Renter will be charged the full amount of both the rental fee and security deposit. No refund or credit voucher will be issued.

• Renter cancellations for holiday and special event rentals are non-refundable. Renter will be charged the full amount of the rental fee and security deposit. No refund or credit voucher will be issued.

• Renters who no-show to their rental booking will be charged the full price of both the rental fee and security deposit. No refund or credit voucher will be issued.

• No refunds or credit vouchers will be issued for unused time or early returns.

• Renters WILL receive a credit voucher for a future rental in the event Lake Tawakoni Boat & Kayak Rentals cancels the booking due to hazardous weather conditions, acts of God, or other unforeseen circumstances. Not all inclement weather qualifies for cancellation. Only hazardous weather conditions, including hail, sleet, tropical storms, hurricanes, tornadoes, lightning storms, high winds, and below freezing temperatures, which may hinder the Renter from safely operating the vessel and/or equipment on the water, qualify for weather related cancellations. Weather conditions are based on the rental start time. Security deposit will carry over to the voucher for a future rental.

• Renter is not eligible for a refund or credit voucher should inclement weather begin after the Renter takes possession of the boat.

CREDIT VOUCHERS:

• Credit vouchers cannot be used the same day as the original booking.

• Credit vouchers cannot be redeemed on special event days or holidays.

• Credit vouchers can only be redeemed by the original Renter. Original Renter must be present at credit rental.

• Credit vouchers cover the Renter, and those passengers present on the original rental booking.

• The original security deposit is applied to credit vouchers for future rentals. Security deposit will be held in order to redeem credit voucher rental in the future.

• Cancellations of credit voucher rental bookings void the credit voucher in its entirety. Credit voucher rentals cancellations are non-refundable. Renter will be charged the full amount of both the rental fee and security deposit.

ADDITIONAL FEES:

• Renter will be charged an additional $150.00 safety fee if any anyone operates the boat while under the influence. We have a no tolerance policies when it comes to risking the safety of our passengers and equipment.

RENTAL FEES:

• Rental fees for boats and equipment are due at the meeting location, prior to rental start time.

• Renter is responsible for the cost of any additional fuel usage beyond the original 10 gallons provided with the boat rental. Additional fuel costs will be deducted from the security deposit or charged separately to the Renter's card on file.

• A standard $25.00 boat cleaning fee for simple cleaning, will apply to every boat rental. Extensive cleaning fees will apply and be charged to the Renter's card on file, if the boat or equipment require extensive cleaning or must be removed from the water to adequately clean for the next rental.

LATE FEES:

•Rental booking start time is defined by the actual time the boat rental is scheduled to begin.

•Rental booking end time is defined by the actual time the Renter and all passengers are scheduled to complete the rental, and the boat and equipment have been returned.

•Arriving and returning early as instructed ensures scheduled launch and end times and prevents launch delays for other Renters. Therefore, late fees are calculated based on the scheduled launch and end time of the rental, not by the actual time the Renter and all passengers load onto or vacate the boat and return all equipment.

•Renters are required to arrive at least 15 minutes prior to their scheduled booking start time in order to receive all safety instructions, sign all necessary documents and waivers, and load all passengers onto the boat by the scheduled rental start time.

•Renters are required to arrive back at the meeting location at least 15 minutes prior to the scheduled booking end time to ensure Renter and all passengers have adequate time to vacate and return possession of the boat and equipment by the scheduled rental end time. Late fees are calculated based on the scheduled completion time of the rental.

• If the scheduled boat launch or end time is delayed by the Renter and/or passengers by 15 -30 minutes, the Renter will be charged an additional $50.00 late fee.

• If the scheduled boat launch time is delayed 30 minutes or more, the rental booking will be cancelled, and the Renter will be charged the full amount of both the rental fee and security deposit. No refund or credit voucher will be issued.

• If the scheduled boat end time is delayed 30 minutes or more, the Renter will be charged an additional $50.00 late fee. No refund or credit voucher will be issued.

MULTIPLE DAY AND OVERNIGHT RENTALS:

• Please contact Lake Tawakoni Boat Rentals directly by phone to book multiple day or overnight rentals. Certain conditions apply.

DELIVERY/PICKUP FOR CERTAIN LOCAL AIR BNB RENTERS:

• Renters staying at Peninsula Ranch may request their rental pontoon be delivered and picked up. Peninsula Ranch is about a 50-minute boat ride from our location, so an additional $125 fee will apply for these services. This covers on-water delivery to Peninsula Ranch and on-water pickup from Peninsula Ranch.

• Renters and all passengers are responsible for reviewing all policies and procedures, prior to booking. By booking a rental, the Renter is acknowledging understanding of and agreeing to comply with all policies and procedures.

BY COMPLETING A RENTAL BOOKING, RENTER ACKNOWLEDGES THAT THESE RENTALS ARE PRIVATE RENTALS AND CONFIRMS THAT HE/SHE HAS READ AND AGREES TO COMPLY TO ALL LAKE TAWAKONI BOAT RENTALS' POLICIES PRIOR TO BOOKING.

RENTER UNDERSTANDS AND AGREES THAT ONCE HE/SHE TAKES POSSESSION OF THE BOAT AND/OR EQUIPMENT, HE/SHE AGREES TO COMPLY WITH HIS/HER FINANCIAL RESPONSIBILITY FOR THE COST OF THE SECURITY DEPOSIT, RENTAL FEE(S), THE COST OF ANY ADDITIONAL FUEL USAGE AND/OR REPAIR COSTS RESULTING FROM DAMAGES AND/OR LOSS WHICH OCCURS TO THE BOAT AND/OR EQUIPMENT WHILE IN THE RENTER'S POSSESSION. THIS INCLUDES ANY AND ALL PART, REPAIR, LABOR AND TOWING COSTS, FOR DAMAGES OR LOSS CAUSED BY THE RENTER OR ANY PASSENGERS PRESENT ON THE BOAT DURING THE RENTAL, AS WELL AS ANY LOSS OF PROFIT FOR THE TIME IT TAKES FOR BOAT AND/OR EQUIPMENT TO BE REPAIRED AND IS UNAVAILABILE FOR USE IN FUTURE RENTALS.

RENTER AGREES NOT TO ATTEMPT TO DEFRAUD THE BOAT AND EQUIPMENT OWNER OR LAKE TAWAKONI BOAT RENTALS BY DISPUTING ANY OF THE CHARGES OR FEES DESCRIBED IN THESE POLICIES, EITHER WITH THEIR FINANCIAL INSTITUTION, LAKE TAWAKONI BOAT RENTALS, OR THE OWNER, AFTER THE FACT.

SECURITY DEPOSITS AND
DAMAGE RESPONSIBILITY

PAYMENTS FOR SECURITY DEPOSITS

DAILY PONTOON RENTALS:

• A refundable $400.00 security deposit is due at time of booking to secure the reservation.

• If the boat and/or equipment are returned on time, without damage, loss, deterioration in their quality, performance or efficacy, the security deposit will be fully refunded, minus any fuel usage or other additional charges, if applicable.

HOLIDAY AND SPECIAL EVENT PONTOON RENTALS:

• A $400.00 security deposit is due at time of booking to secure the reservation.

• Due to high demands for rentals on holidays and during special events, the $100.00 of the security deposit is non-refundable.

• Holidays include, but are not limited to, New Year's Eve, New Year's Day, St. Patrick's Day, Memorial Day, Independence Day, Labor Day, Veteran's Day, Halloween, Thanksgiving, Christmas and any Special Calander Events.

• Holiday/Special Calander Event rates will apply to the day of the actual holiday and the weekend before or after, depending on what day of the week the holiday or special calendar event falls on.

FINANCIAL RESPONSIBILY OF RENTER:

• Please note that when the time frame of the rental is over and the Renter has returned the watercraft and equipment back Lake Tawakoni Boat Rentals' possession and upon inspection, it is determined that the watercraft or equipment have sustained any damages or loss, requires refueling, maintenance, and/or repairs, before the watercraft can be put into use again, the Renter's security deposit will be applied to the necessary maintenance and/or repair costs.

• Any additional costs which exceed the amount of security deposit, to cover loss, repairs and/or damages to the watercraft and/or equipment, and/or any fuel usage or other additional costs, will be charged to the Renters' card on file and may not be disputed after the fact.

• Renter is also financially responsible for any damage or loss to the watercraft and/or equipment made by any passengers in their party.

WHAT TO KNOW:

It is the sole responsibility of every customer to review and become familiar with all of Lake Tawakoni Boat Rentals' policies prior to booking a rental. By booking a rental, the Renter is acknowledging his/her understanding of and agreeing to abide by all policies, all terms and conditions.

• Your meeting location is The Duck Cove Marina located at 2757 Private Road 3824, Quinlan, TX, 7547. Please arrive 20 minutes prior to your rental start time and call our office when you arrive. A representative will meet you at the dining tables located just outside The Quack Shack, upon your arrival.

NOTICE FOR PONTOON RENTALS:

• The Operator of the boat must be at least 25 years of age or older and have a valid driver's license and valid boating license. Anyone Renter or boat operator that is 25 years of age or older, who does not have a valid boating license or at least 5 years of personal boat ownership and experience, will require a Captain for their rental. Exceptions must be authorized by Lake Tawakoni Boat Rentals prior to booking.

• The Texas Parks and Wildlife Department requires anyone driving the boat who was born on or after September 1, 1993, to complete a Boater Education Course. You must provide Texas Water Sport Rentals with proof of your completed course prior to launch. Please refer to the link below for information about the course. 👇

• Rental will be cancelled if boat operators, who are required, fail to complete the Boater Education Course at least 48 hrs prior to the scheduled rental start time.

• All age passengers are welcome to participate in rental activities.

• All minor children must be accompanied by a parent or guardian.

• Please notify Lake Tawakoni Boat Rentals, in advance, of the age and weight of each minor child that will be passengers on the boat, so we can provide each of them with a properly fitted life vest.

• Renter and all passengers must be present at the marina at the start time of all boat rentals. Any additional passengers, not present for the verbal safety briefing or to sign liability waivers and safety documents prior to Renter taking possession of the boat, are prohibited from boarding the boat after the rental has started.

• Renter and boat operators are prohibited from docking or tying up the boat to any structure other than the slip at Duck Cove Marina. This includes, but is not limited to, docks, piers, slips, bridges, boat ramps, launches, stumps, shorelines or other boats or vessels.

• The anchor must be used to secure the boat to the lakebed, at least 500 ft from any shoreline or structure, if the Renter or passengers wish to swim or fish.

• In the event the Renter needs to return to the marina at any time during the rental, Lake Tawakoni Boat Rentals must be notified by phone, at least 30 minutes prior, so representatives can be dispatched to help the Renter pull the boat back into and out of the slip.

• For safety purposes, Renters and boat operators are prohibited from pulling the boat in and out of the designated slips, without assistance of Lake Tawakoni Boat Rentals staff.

• NO TOWING OF ANY KIND WITHOUT A CAPTAIN PROVIDED BY TAWAKONI BOAT RENTALS, INCLUDING BUT NOT LIMITED TO, SKIS, TUBES, BANANA BOATS, WAKE BOARDS, KNEE BOARDS, AND OTHER BOATS OR WATERCRAFTS.

TEXAS STATE LAW PROHIBITS LIVERY BOATS FROM BEING OPERATED ON THE WATER BEFORE SUNRISE OR AFTER SUNSET. BOATS AND EQUIPMENT MUST BE RETURNED TO THE MARINA NO LATER THAN 30 MINUTES PRIOR TO SUNSET.

ADDITIONAL INFORMATION:

• Weekday rentals include Monday-Thursday.

• Weekend rentals include Friday-Sunday and Monday & Thursday if a holiday falls on such days.

• Holiday rentals include the actual day of the holiday, and the Friday-Sunday weekend which most closely precedes or succeeds the actual holiday.

• Special event rentals include each day of the Friday-Sunday weekend of the actual event.

• You may bring any food and/or drinks, including a cooler. (NO GLASS) Boat operator is prohibited from consuming alcoholic beverages. If everyone in your party plans to consume alcoholic beverages, a Captain will be required.

• All of our vessels are equipped with cameras and a Live GPS Mapping & Monitoring System, used for monitoring the vessel's location and systems. They act as a direct communication link between the boats being rented and Lake Tawakoni Boat Rentals staff.

• Our pontoons are prohibited from leaving Lake Tawakoni and are required to stay within the designated areas of the lake, determined by Lake Tawakoni Boat Rentals. (Pontoons -Waco Bay) A map will be provided to the Renter outlining the authorized and prohibited areas of the lake.

• 10 gallons of gas are provided for all daily boat rentals. The cost of any additional fuel use beyond the provided 10 gallons, is the responsibility of the Renter to pay. Additional fuel cost will be deducted from the Renter's security deposit. Additional fuel costs for boat rentals are $6.50 per gallon.

• Boats must be returned with a full tank of gas for overnight and multiple day rentals, unless the Renter would prefer for Lake Tawakoni Boat Rentals to refuel the boat, in which case, the cost of $6.50 per gallon will be deducted from the Renter's Security Deposit.

• Rabbit Cove Marina, on Lake Tawakoni, has drive-up marine fuel pumps, should the Renter choose to refuel during their rental.

• Towing of any kind is prohibited. This includes, but not limited to, skies, tubes, knee boards, wake boards, and banana boats.

• Unused time is non-refundable in the event the Renter chooses or needs to end the rental early.

• Renters, boat operators, and passengers are responsible for becoming familiar with Lake Tawakoni Boat Rentals policies, procedures, terms and conditions, prior to booking. By completing a rental booking, Renter, boat operators, and all passengers acknowledge, understand, and agree to all policies, procedures, terms and conditions.

NOTICE REGARDING MECHANIAL OR EQUIPMENT FAILURE:

• It is important to keep in mind that our livery boats run multiple times a day for 4-12 hours each rental. They are not personal vessels which only go out a few times a month, so service and maintenance is required much more frequently.

• We work hard to keep our boats in good running condition, but due to their frequent use, there may be times when need for a repair presents itself during a rental.

• We have a marine mechanic on staff who will immediately respond to any repair needs that may occur.

• These kinds of repairs typically take no more than 20 minutes to complete.

• Any time the renter may lose during their rental to complete repairs, will be compensated by either extended time to the rental, equivalent to the time lost, or issue a credit voucher for the future, during the present season, equivalent to the time lost. Vouchers cannot be redeemed on holidays, or special calendar events days.
